These terms and the Club Rules (as amended from time to time) govern the contract between you and us. You can find a copy of the current version of the Club Rules by logging onto brettvalegolf.co.uk or by asking for a copy from one of our staff Members at the Club.
Why you should read them. Please read these terms carefully before you submit your Membership Application to us, on payment of your Fee you agree to all terms and conditions.
These terms tell you who we are, how we will provide the Membership to you, how you and we may change or end the contract, what to do if there is a problem and other important information
In these terms whenever the following words and phrases appear, they will have the following meaning, unless the context requires otherwise:
Annual Renewal Date: means 1st of April each year.
Company: means Brett Vale Golf Club Limited, referred to as ‘Company’ or ‘We’
Club: means Brett Vale Golf Club, Noakes Road , Raydon, Ipswich, Suffolk IP7 5LR.
Club Rules: means our General Club rules (as amended from time to time), available at www.brettvalegolf.co.uk
Fee/Fees: – Means your Annual Fee or payment of your Suffolk Golf Union Fee.
Membership: means your enrolment into the Club, upon the acceptance of your Membership Application by us.
Membership Application: means the application form to be completed by you, as provided by us, for the Membership.
Membership Term: means the period of your Membership, commencing on the Start Date.

How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your Membership Application.
" Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.
When your Membership will commence.
Your Membership will commence on the date notified by us to you when accepting your Membership Application (Start Date, normally the 1st April)
Duration of the Membership. Your Membership shall continue from the Start Date until the next Annual Renewal Date.
Notice to cancel Membership. Please note you cannot cancel or hold your Membership during a Membership Year. For the avoidance of doubt, you will be committed to pay us for each Membership Year (and in the event that the Start Date is anything other than 1st April, for such period of time between the Start Date and the first Annual Renewal Date) that your Membership continues.
Fees for the Membership
Membership fees are calculated in accordance with the Membership package that you have purchased (as set out in the Membership Application). Membership fees must be paid in full for each Membership Year in advance of the Start Date or, the Annual Renewal Date of the Membership or, by monthly direct debit instalments. Where the Start Date is any date other than 1st April, your Membership fee will be calculated on a pro-rata basis for the period of time between the Start Date and the first Annual Renewal Date. Other than where a Promotional / Introductory Offer has been presented by BVGCL.
Membership fees shall be fixed for each Membership Year and, we reserve the right to amend the Membership fees prior to the commencement of the next Membership Year by providing you with at least 30 days notice.
Our contract with you and the Membership
How we will accept your Membership Application. Our acceptance of your Membership Application will take place when we tell you that we are able to provide you with the Membership, at which point a contract will come into existence between you and us.
We have the right not to offer you a Membership with the Club, without reason.
What happens once we accept your Membership Application
Following the acceptance.
Membership Application. The subscription fee will be non-refundable after 14 Day Cooling Off Period of which any golf played will be deducted according to applicable green fee.
If we terminate the contract without reason.
We have the right to terminate your Membership without reason, upon providing you with 30 days written notice. In such circumstances, we will refund any amount paid by you to us for the Membership, for any period of the Membership Year that you will no longer be a Member of the Club. Where you have not paid in advance, we will not charge you for any period where you will cease to be a Member of the Club.
Booking
All golf sessions must be booked by you in advance. (Tee times will be available at 8pm 7 days in advance for all Membership tiers) We have the right to refuse you access to the golf course where a prior booking has not been made by you. Deliberate abuse of the booking system may result in suspension or termination of your Membership.
Bookings can be made (subject to availability), online.
If there is a problem with the Club facilities
How to tell us about problems.
If you have any questions of complaints about the facilities offered by the Club, please contact us or use the suggestion box by the main entrance.
Liability and Personal Responsibility
You must adhere to all signs, notices and information intended for your safety and the safety of others at the Club. For your safety, you must ensure that you are not in the path of moving golf balls, clubs or buggies at any time.
If you suffer an accident whilst at the Club premises or grounds, you must promptly report details of the incident to a senior Member staff on duty. We do not accept liability for any accident or injury caused to you whilst at the Club, or out on the course.
Should you find property that appears to be lost, this should be handed to a Member of staff at the Club immediately. We will keep lost property in our possession for a maximum period of 1 months. If the lost property is not claimed within this period, we have the right to dispose of the property without notice.
Our responsibility for loss or damage suffered by you.
We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process. In any event, you must take reasonable care when using the Club facilities and the golf course (including, without limitation, checking the playing surface of the golf course to confirm that it is suitable for you to use, before commencing play).
Damage to your property.
We do not accept liability for your cars (or other vehicles), the contents of such vehicles or other property that you bring to the course.
How we may use your personal information
How we will use your personal information. We will use the personal information you provide to us to:
provide the Membership to you; and
process your payment for the Membership.
We are also required to pass this information to England Golf to process your Handicap scoring.
Other important terms.
Should the Club be closed due to bad weather, re-development work or under direction from a local authority or the government, it is recognised that your Membership will continue and this contract will remain valid.
Both the Club and all Members accept that this Membership has variations on monthly and seasonal usage, and it is, therefore, not reasonable to dispute continuity of service based on one or more month's service interruption.
Members are responsible for their guest.
This means it is the Members responsibility to make sure their guest is checked in at all times. If payment is not made before a guest tees off the club has the authority to retrieve the money from the Members account without prior approval. A Member may not introduce the same guest more than once a month using Members Green Fee discount.
The Club will endeavor to provide the golf course and communal areas in the best condition possible. This may, from time to time, result in closure of holes or parts of holes to make improvements considered to be in the best long-term interest of the course.
Conduct, Suspension and Expulsion of Members
All Members agree to abide by the Club's code of conduct, which is to respect the Club's property, staff, fellow Members, and visitors at all times. The Club reserves the right to revoke a Membership without compensation if this code is not adhered to by any Member. This code includes taking care not to publish any information on any social media platform that is hearsay, non-factual or their opinion, which may discredit Brett Vale Golf Club Limited.
If the Company considers that any Member's conduct, either at or outside the Club Premises or on social media, is contrary to the interests of the Club and injurious to the reputation of the Company, it may suspend such Member. The Member shall immediately be excluded from the Club premises.
Any person whose Membership has been terminated under these Rules shall forfeit all the privileges of Membership and all rights against the Company and shall not be entitled to any refund of any Membership Fees or customer credit.
Members must pay any bills that they incur before they leave the Company premises.
